Notice of Requirement for a new water reservoir, and associated resource consent applications for an outfall structure and discharges to Borck Creek at 520 Hill Street South, Richmond.

Proposal

The Notice of Requirement seeks to establish a designation in the Tasman Resource Management Plan (TRMP) for “water supply purposes” to establish and operate a new water reservoir at 520 Hill Street South, to service the Richmond South area. 

The application also seeks an associated discharge permit and land use consent related to the discharge of water from the reservoir to upper Borck Creek, for integrity testing, incidental discharges during construction, and discharges during reservoir maintenance and overflow (emergency events).  An outfall structure is to be built to manage flows into the creek. 

The site was selected due its ability to serve the intended areas of the Residential Zone, and its elevation. Elevation is important as the reservoir will form part of the wider Richmond reticulated water supply network and must balance with other parts of the network.

The reservoir will have a total storage capacity of 2,500 m3. The reservoir is circular, 22 m in diameter (internally) and 8.7 m tall. It will be formed from concrete precast panels and constructed on site. Earthworks will be carried out to provide a suitable platform for the reservoir to sit on. This facility will be accessed via a driveway in generally the same location as the driveway that currently exists providing access to No.520 Hill Street South.

The applicant has requested public notification of the application under section 95A (3)(a) of the Resource Management Act, 1991.  

Notice Of Requirement for Designation - RM240327

A Notice of Requirement has been submitted to Tasman District Council for a designation for “water supply purposes”.

 The proposed water reservoir would, if land use consents were applied for, not comply with the following conditions of Rule 16.6.2.1:

  • Rule 16.6.2.1 (b) which requires that above ground network utilities are not located on an identified ridgeline.
  • Rule 16.6.2.1 (e) which requires that screen planting screens the reservoir from all road and public places.
  • Rule 16.6.2.1 (g)(i) which requires that above ground utilities have a ‘ground floor area’ of no more than 50m2.
  • Rule 16.6.2.1(g)(ii) which requires that the maximum building height of utilities is 7.5m the Rural 1 Zone.

The proposed water reservoir construction would, if land use consents were applied for, not comply with the conditions of Rule 18.5.2.1 relating to land disturbance.

Because a Notice of Requirement has been submitted, this overrides the above TRMP provisions, and a land use consent is not required if the designation proceeds.    

Discharge permit - RM240328

Discharge to Water Rules – Tasman Resource Management Plan

The proposed discharge of water from the reservoir during testing/commissioning, maintenance and emergency overflow is assessed as a discretionary activity under Rule 36.2.3.1 of the TRMP as the proposed discharge would not comply with the following conditions of Rule 36.2.2.8:

  • Rule 36.2.2.8 (b) as there may be more than 0.5 g/m3 of free or residual chlorine during emergency events;
  • Rule 36.2.2.8 (c) as there are likely to be contaminants other than heat in the discharge from the maintenance and commissioning of the reservoir; and
  • Rule 36.2.2.8 (e) as the discharge rate will be greater than 5 L/s during commissioning and the discharge rate may exceed 40 L/s during an emergency overflow event.

Bed Disturbance Activities Rules – Tasman Resource Management Plan

The proposed installation of the outfall structure is a discretionary activity under TRMP Rule 28.1.8.1 as the outfall structure will be more than 2m2 in size.

Any person may make a submission on the application, but a person who is a trade competitor of the applicant may do so only if that person is directly affected by an effect of the activity to which the application relates that—

a) adversely affects the environment; and
b) does not relate to trade competition or the effects of trade competition.
